General Terms and Conditions – Vollner Watches

Article 1 – Definitions

• Cooling-off period: The time frame within which the consumer may exercise their right of withdrawal.

• Consumer: A natural person who is not acting in the course of a business or profession and who enters into a distance agreement with the vendor.

• Day: A calendar day.

• Long-term transaction: A distance agreement involving a series of products/services delivered or performed over time.

• Durable data carrier: Any medium that allows information to be stored in a way that enables future reference and unchanged reproduction.

• Right of withdrawal: The option for the consumer to cancel the agreement within the cooling-off period.

• Vendor: Vollner Watches or its legal representatives offering products/services at a distance to consumers.

• Distance agreement: An agreement concluded remotely using one or more communication techniques.

• Remote communication technique: A method to conclude agreements without being physically present.

• General Terms and Conditions: The current terms of sale set by Vollner Watches.

Article 3 – Applicability

These terms apply to every offer and agreement between Vollner Watches and the consumer.

They are made available to the consumer before concluding the agreement and accessible on a durable data carrier.

In the case of conflicting terms, the most favorable interpretation for the consumer applies.

If any provision is found invalid, the remaining provisions remain in effect.

Uncovered situations or ambiguities will be interpreted in line with the intent and spirit of these terms.

Article 4 – The Offer

• Offers are non-binding and may be adjusted.

• Descriptions and visuals are accurate, though variations in product colors may occur.

• Consumers are informed about:

• Final prices (excluding any customs/VAT fees)

• Shipping costs (if any)

• The order and payment process

• Whether the right of withdrawal applies

• Delivery terms

• Contract duration and termination conditions (if applicable)

Article 5 – The Agreement

The agreement is binding when the consumer accepts the offer and meets all conditions.

For online orders, confirmation will be sent via email.

The vendor secures all electronic data exchanges and ensures a safe environment for online transactions.

The vendor reserves the right to refuse orders for legitimate reasons and will inform the consumer.

Consumers will receive:

• Business contact details

• Withdrawal instructions or notification of exclusion

• Warranty information and after-sales service

• A summary of relevant terms

Article 6 – Right of Withdrawal

Consumers may cancel the agreement within 14 days of receiving their order.

Items must be returned unused, complete, and in original packaging.

Withdrawal must be communicated via email, and products must be returned within 14 days of notification. Proof of return must be provided.

Article 7 – Costs in the Event of Withdrawal

Return shipping costs are the responsibility of the consumer.

Refunds will be processed within 14 days after the product is returned or proof of return is received.

Article 8 – Exclusion of Right of Withdrawal

The right of withdrawal may not apply to:

• Custom-made or personalized items

• Products not suitable for return due to hygiene or nature

• Digital goods once access has been granted

Exclusions must be clearly stated prior to purchase.

Article 9 – The Price

Prices remain valid during the offer period. Any price changes due to VAT or market conditions will be stated clearly.

No VAT will be charged by Vollner Watches; instead, customs/import taxes may be collected by the carrier upon delivery.

Vollner Watches is not liable for typographical pricing errors and may refuse orders based on such mistakes.

Article 10 – Conformity and Warranty

Products will meet expectations as described. Defects caused by misuse are not covered.

Article 11 – Delivery and Execution

Orders will be fulfilled with care and dispatched within 30 days unless otherwise agreed.

If a delay or stock issue occurs, consumers will be notified and may cancel the order for a full refund.

Risk transfers to the consumer upon delivery.

Article 12 – Payment

All payments must be made upon placing the order unless otherwise agreed.

Consumers must notify the vendor of payment issues immediately.

Failure to pay may result in additional collection costs.

Article 13 – Complaints and Disputes

Vollner Watches has a complaint procedure. Consumers must report complaints promptly.

Unresolved disputes may be taken to court or submitted to the European ODR platform.

Article 14 – Additional Provisions

Additional or differing provisions may not harm the consumer and must be accessible on a durable data carrier.
